If you hire a baker to make a cake with the Star Trek symbol on it and you pay for the cake, then the baker must get clearance to use any symbol or even any modification of the symbol. Copyright laws are very strict.
If YOU made a cake with the Star Trek symbol, that woudn't be an issue.

Who's going to phone the police, seriously? Uptight bakers? The rules are there so you think before you break them - so if it's just a one off cake I doubt the makers of Star Trek will be writing upset letters anytime soon. It's not like you're going to be selling Star Trek cakes as a business without paying royalties is it?
Depends on how tight your bakery is. Most have no problems because really, it's a private party and unless you have the copyright police at his wedding or anyone connected with the franchise you will have no problem. People get birthday cakes with pictures on it all the time. Also, think of all those Trekker weddings that go on I am sure those cakes are all Star Trek themed. And nobody is really making money selling hordes of Star Trek cakes here.
